These Terms of Service (“Agreement”) govern the use of images of products created by New Century Headstones (“Company”) and provide information regarding the option for customers to opt out of such usage. By using our services, and, or purchasing our products, you (“Customer”) agree to be bound by this Agreement.

Image Usage:
1.1 The Company retains the right to use images of the products it creates for marketing, promotional, and advertising purposes, including but not limited to the Company’s website, social media channels, print materials, and other marketing collaterals.
1.2 The images may include but are not limited to, photographs, illustrations, videos, clips, and digital representations of the products.
1.3 The photographs, illustrations, videos, clips, and digital representations of the products may be used in both online and offline mediums and may be modified or edited as necessary for promotional purposes.

Customer Opt-Out:
2.1 The Company respects the privacy and preferences of its customers. If a Customer does not wish for their product images to be used for marketing, promotional, or advertising purposes, they may opt out by sending an email to info@newcenturyheadstones.com, clearly stating their request and providing relevant information such as their name and order details.
2.2 Upon receiving an opt-out request, the Company will promptly cease using the Customer’s product images for marketing, promotional, or advertising purposes.
2.3 The opt-out request will be effective from the date of receipt by the Company and will apply only to future uses of the Customer’s product images. Any images already in circulation or use prior to the opt-out request may continue to be used in accordance with this Agreement.

Intellectual Property:
3.1 All rights, title, and interest in the images used by the Company, including any intellectual property rights, are and will remain the exclusive property of the Company.
3.2 The Customer acknowledges that they do not acquire any ownership rights or licenses to the images by using or purchasing the Company’s products.
3.3 The Customer agrees not to reproduce, distribute, modify, or create derivative works based on the images without the explicit written permission of the Company.

Indemnification:
4.1 The Customer agrees to indemnify and hold the Company and its affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising out of or related to the use of the images, including any claims of infringement or violation of intellectual property rights.

Amendments:
5.1 The Company reserves the right to modify or amend this Agreement at any time without prior notice. It is the Customer’s responsibility to review this Agreement periodically for any changes.
5.2 Continued use of the images after any modifications or amendments to this Agreement shall constitute the Customer’s consent to such changes.

Governing Law:
6.1 This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is located.

Please read this Agreement carefully before using New Century Headstones, and affiliates services or purchasing its products. If you do not agree to any provisions of this Agreement, please refrain from using New Century Headstones and affiliates’ services or from purchasing its products. By using New Century Headstones and affiliates’ services or purchasing its products, you acknowledge that you have read, understood, and agreed to be bound by all the terms and conditions of this Agreement.
